利用規約

第1条（適用）

本規約は、眞先 哲夫（以下「当方」といいます）が提供するアプリケーション「おくすり家族ノート」（以下「本アプリ」といいます）の利用条件を定めるものです。利用者は、本アプリを利用することにより、本規約に同意したものとみなします。

第2条（本アプリの性質）

  1. 本アプリは、家族が高齢の親などの服薬・体調を記録・共有し、診察時に医師に提示するための「家族向けのノート」として機能します。
  2. 本アプリは、診断、治療、症状の重症度判定、薬剤の飲み合わせ判定、緊急度判定、その他の医療判断を行うものではありません。
  3. 医療上の判断は、必ず医師、薬剤師その他の医療専門家にご相談ください。

第3条（利用環境）

  1. 本アプリの利用には、Apple ID と iCloud アカウントが必要です。
  2. ご家族で共有してご利用になる場合は、同じ Apple ID で各自の端末にログインしてください。記録は同じ Apple ID の端末間で同期されます。

第4条（無料プランと有料プラン）

  1. 本アプリは、無料プランおよび有料プラン（自動更新サブスクリプション）を提供します。
  2. 無料プランには、以下の機能制限があります：
    • 見守り対象者：1 名まで
    • 登録できる薬：5 件まで
    • サマリー PDF 生成：月 1 回まで
    • 音声メモ：月 5 件まで
  3. 有料プラン（家族プラン）は、月額または年額の自動更新サブスクリプションとして提供されます。
    • 月額プラン：¥500 / 月
    • 年額プラン：¥4,800 / 年
  4. 価格は本規約改定時点のものであり、Apple 社のレート見直しや本アプリの方針により変更される場合があります。価格変更時は、Apple 標準の同意フローに従って事前に通知されます。

第5条（自動更新サブスクリプション）

  1. 有料プランは、購入時の Apple ID に課金されます。
  2. サブスクリプションは、現在の期間終了の 24 時間以上前にオフにしない限り、自動的に更新されます。
  3. 更新の課金は、現在の期間終了の 24 時間以内に行われます。
  4. 購入後の管理・解約は、「設定」→「Apple ID」→「サブスクリプション」からいつでも行えます。
  5. 解約・払い戻しに関する基本ルールは、Apple 社の利用規約に従います。

第6条（禁止事項）

利用者は、本アプリの利用にあたり、以下の行為を行ってはなりません。

  1. 法令または公序良俗に違反する行為
  2. 当方、他の利用者、または第三者の権利・利益を侵害する行為
  3. 本アプリのリバースエンジニアリング、改変、または不正アクセスを試みる行為
  4. 医療従事者を装い、または医療判断を行うかのように本アプリを利用する行為
  5. 本人の同意を得ずに、他者の個人情報・健康情報を本アプリに登録する行為
  6. その他、当方が不適切と判断する行為

第7条（知的財産権）

  1. 本アプリ自体（プログラム、UI、マスコット、デザイン、ドキュメント等）に関する一切の知的財産権は、当方または正当な権利者に帰属します。
  2. 利用者が本アプリに入力したデータ（記録、コメント、写真、音声から起こした文字情報等）の権利は、利用者に帰属します。当方は、これらのデータを利用者の同意なく利用・公開しません。

第8条（免責事項）

  1. 当方は、本アプリの完全性、正確性、有用性、特定目的への適合性について、いかなる保証も行いません。
  2. 本アプリの利用または利用不能から生じた利用者または第三者の損害について、当方は責任を負いません。
  3. iCloud を含む Apple 社のサービスの停止・障害・データ消失等に関しては、Apple 社の利用規約に従い、当方は責任を負いません。
  4. 利用者がデバイスの紛失・故障・iCloud のサインアウト等によりデータにアクセスできなくなった場合、当方はデータの復元に関する責任を負いません。
  5. 本アプリは医療機器ではなく、医療判断・診断・治療に用いるものではありません。 本アプリの記録内容に基づく医療上の判断・行動について、当方は一切の責任を負いません。

第9条（プライバシー）

利用者の個人情報・利用情報の取扱いについては、別途定める プライバシーポリシー に従います。

第10条（サービスの変更・停止）

  1. 当方は、利用者への事前通知なく、本アプリの内容を変更し、または提供を停止することがあります。
  2. 当方は、本アプリの変更・停止により利用者に生じた損害について、責任を負いません。

第11条（規約の変更）

当方は、必要に応じて本規約を変更することがあります。変更後の本規約は、本ページに掲示した時点から効力を生じます。

第12条（準拠法・裁判管轄）

本規約は日本法に準拠し、解釈されます。本規約に関連する一切の紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Use (English)

1. Scope: These Terms govern your use of "Okusuri Kazoku Note" ("the App") provided by Tetsuo Masaki ("we"). By using the App, you agree to these Terms.

2. Nature of the App: The App is a family note-taking tool for recording and sharing an elderly parent's medications and condition to show a doctor at a visit. It does not provide diagnosis, treatment, severity assessment, drug-interaction checks, urgency assessment, or any medical judgment. Always consult a physician or pharmacist for medical decisions.

3. Requirements: An Apple ID and iCloud account are required. To use the App as a family, sign in to each device with the same Apple ID; records sync across devices using the same Apple ID.

4. Free & Paid Plans: The free plan limits 1 watched parent, 5 medicines, 1 summary PDF per month, and 5 voice notes per month. The paid "Family Plan" is an auto-renewing subscription: ¥500/month or ¥4,800/year. Prices may change subject to Apple's pricing and our policy, with prior notice via Apple's standard consent flow.

5. Auto-Renewing Subscription: Billed to your Apple ID. Renews automatically unless turned off at least 24 hours before the current period ends; renewal is charged within 24 hours of period end. Manage or cancel anytime via Settings → Apple ID → Subscriptions. Cancellation and refunds follow Apple's terms.

6. Prohibited Conduct: You may not violate laws or public order; infringe the rights of us, other users, or third parties; reverse-engineer, modify, or attempt unauthorized access to the App; use the App while impersonating a medical professional or as if rendering medical judgment; register others' personal or health information without their consent; or engage in any conduct we deem inappropriate.

7. Intellectual Property: All intellectual property in the App (program, UI, mascot, design, documents) belongs to us or rightful owners. Data you enter (records, comments, photos, transcribed text) belongs to you; we do not use or disclose it without your consent.

8. Disclaimer: We make no warranty as to completeness, accuracy, usefulness, or fitness for a particular purpose. We are not liable for damages arising from use or inability to use the App, nor for outages, failures, or data loss of Apple services (including iCloud), nor for inability to access data due to device loss, failure, or iCloud sign-out. The App is not a medical device and must not be used for medical judgment, diagnosis, or treatment. We bear no responsibility for medical decisions or actions based on the App's records.

9. Privacy: Handling of personal information is governed by our Privacy Policy.

10. Changes / Suspension: We may change or suspend the App without prior notice and are not liable for resulting damages. We may revise these Terms; revisions take effect when posted on this page.

11. Governing Law: These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction of first instance over any dispute.
